General provisions

These terms and conditions regulate, in accordance with Section 1751, paragraph 1 of Act No. 89/2012 Coll., the Civil Code, the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase contract concluded between the seller, the company Dachs Knives sro, with its registered office at No. 124, 517 72 Jílovice and operations at the address Jilovice 124, ZIP code: 51772, ID number 10941011 and another natural person through the online store www.dachsknives.com

The buyer has the opportunity to familiarize himself with the terms and conditions before sending his order and is sufficiently informed about them in advance. By sending his order, the buyer confirms that he has familiarized himself with the terms and conditions and that he agrees with them. All contractual relationships are governed by the law of the Czech Republic.

Purchase agreement

By completing and sending the order, the buyer confirms that he has read the terms and conditions and that he agrees with them. Confirmation of the order by the seller creates a purchase contract between the seller and the buyer (consumer). The order confirmation is delivered to you at the e-mail address you have chosen. If you wish to change a confirmed order, you must contact the seller immediately and arrange to cancel the order and create a new order.

All presentation of goods placed on the web interface of the store www.dachsknives.com is of an informative nature and the seller is not obliged to conclude a purchase contract regarding these goods.

The resulting contract (including the agreed price) can only be changed or cancelled by agreement of the parties or on legal grounds.

The business relationship between the seller and the buyer, who is not the end consumer, is resolved according to individually agreed terms. This means that the seller is entitled to unilaterally refuse to conclude a purchase contract. He informs the buyer about this fact in writing to his email address specified in the order.

The buyer has the right to cancel the order, i.e. to withdraw his proposal to conclude a purchase contract, without any penalties until the moment the goods are shipped. The buyer is obliged to notify the seller of the cancellation of the order via email or telephone.

Prices of goods and services are listed in CZK including the applicable VAT rate according to applicable legislation.

Withdrawal from the purchase contract

If the purchase contract is concluded using means of distance communication (in an online store), the consumer has the right, in accordance with Section 1829, paragraph 1 of the Civil Code, to withdraw from the contract without giving a reason within 14 days of receipt of the goods (if the subject of the purchase contract is several types of goods or the delivery of several parts, this period runs from the date of receipt of the last delivery of goods). The withdrawal from the purchase contract must be sent to the seller within the period specified in the previous sentence.

In the event of withdrawal from the Purchase Contract, it is necessary to return the undamaged goods, without signs of use or wear, in the original packaging and with all accessories within 14 days (the date of delivery of the goods to the seller is decisive).

If the consumer wishes to withdraw from the contract within 14 days, according to the previous paragraph, he/she shall contact the seller and preferably state in writing that he/she is withdrawing from the contract, ideally stating the order number, date of purchase and account number for the refund.

To withdraw from the purchase contract, the consumer may also use the sample form provided by the seller, which is an annex to these terms and conditions. The consumer may send the withdrawal from the purchase contract, among others, to the seller's address or to the seller's e-mail address info@dachsknives.com.

In the event that the buyer withdraws from the contract in accordance with the previous paragraphs, the seller shall return the funds received from the buyer (except for the amount representing additional costs for the delivery of the goods incurred as a result of the buyer's chosen method of delivery of the goods, which is different from the cheapest method of standard delivery of the goods offered by the seller) within 14 days of the buyer's withdrawal from the purchase contract, in the same way as the seller received them from the buyer, unless the buyer specifies otherwise. The seller is also entitled to return the performance provided by the buyer when the goods are returned by the buyer or in another way, if the buyer agrees to this and no additional costs are incurred by the buyer. If the buyer withdraws from the purchase contract, the seller is not obliged to return the funds received to the buyer before the buyer returns the goods or proves that he sent the goods to the seller.

However, the provisions of the Act on withdrawal from the contract within 14 days cannot be understood as the possibility of borrowing goods free of charge. In the event that the consumer exercises the right to withdraw from the contract within 14 days of taking over the performance, he must return to the seller everything he has acquired under the purchase contract within 14 days of withdrawal from the contract. If this is no longer possible (e.g. the goods have been destroyed or consumed in the meantime), the consumer must provide monetary compensation as a countervalue for what can no longer be returned. If the returned goods are only partially damaged, the seller may exercise the right to compensation from the consumer and set off his claim to the returned purchase price. In such a case, the seller is obliged to prove the damage incurred. In such a case, the seller shall return to the consumer only the purchase price thus reduced.

The seller may offset the actual costs incurred in returning the goods against the purchase price to be refunded to the buyer.

The purchase price for the goods will be refunded immediately by bank transfer to the account you provided, or, after agreement, the refund can be made in another suitable way.

Transportation and delivery of goods

The buyer bears the costs of postage and packaging according to the method chosen when ordering the goods, unless otherwise stated in the order and on the e-shop website. These costs are governed by the prices listed on www.dachsknives.com

If the seller is obliged to deliver the goods to the place specified by the buyer in the order under the purchase contract, the buyer is obliged to take over the goods upon delivery. When taking over the goods from the carrier, the buyer is obliged to check the integrity of the packaging of the goods and in the event of any defects, immediately notify the carrier. If damage to the packaging is found indicating unauthorized entry into the shipment, the buyer does not have to take over the shipment from the carrier.

If, for reasons on the buyer's side, it is necessary to deliver the goods repeatedly or in a different way than specified in the order, the buyer is obliged to pay the costs associated with the repeated delivery of the goods or the costs associated with a different method of delivery.

The shipment is sent by a shipping company to the customer's delivery address. Shipping costs are charged in addition to the price of the goods according to the tariff below.

Exchange of goods

In case of selecting unsuitable goods, we will exchange unused and undamaged goods for other goods. The exchange of goods must be applied for within 14 days from the date of delivery of the goods. The seller will not accept cash on delivery shipments.

The costs associated with the exchange are borne by the customer.

Refunds by postal order are not possible.

Complaint

Goods can be claimed according to the current legal standards. We provide a guarantee for all goods for the period of their shelf life - expiration. The buyer is obliged to inspect and check the goods without unnecessary delay. If the shipment is damaged, we recommend not accepting the shipment and immediately contacting the seller (if damage occurs during the transport of goods, the carrier is responsible for the damage incurred - by accepting you expose yourself to possible problems with a claim or withdrawal from the purchase).

If defects are discovered, the buyer is obliged to immediately notify the seller by e-mail, in writing or by telephone.
